Question :

What is the ruling on praying with closed shoes ON for example when you are in a park etc.
Is it permissible in both the Hanafi and Shafi Madhabs??

Answer:

(Hanafi)

The general ruling is that it is permissible to pray with shoes, on the condition that the shoes are clean (free from najis).

It has been narrated in the following hadiths that the Prophet (Sallallahu Alayhi Wasallam) advised to perform Salah with shoes to differentiate with the Jews as they did not pray with shoes.

عَنْ يَعْلَى بْنِ شَدَّادِ بْنِ أَوْسٍ, عَنْ أَبِيهِ قَالَ: قَالَ رَسُولُ اللَّهِ -صلى الله عليه وسلم-: «خَالِفُوا الْيَهُودَ, فَإِنَّهُمْ لاَ يُصَلُّونَ فِى نِعَالِهِمْ وَلاَ خِفَافِهِمْ
(Abu Dawud)

وفي سنن أبي داوود والحاكم من حديث شداد ابن أوس رضي الله عنه أن النبي صلى الله عليه وسلم قال: ((خالفوا اليهود والنصارى فإنهم لا يصلون في نعالهم ولا خفافهم

“Oppose/Act differently from the Jews and Christians for they do not pray in their shoes nor khufs (leather socks).”

The Hanafi jurist Allama Ibn Abidin comments in his Radd al-Muhtar,
“And praying in sandals is better.”

“… if they are free of filth, because of the hadith [of the Prophet (SAW)], ‘Pray in your sandals, and do not be like the Jews,” [who did not do so] …

Some scholars have stated that the reason that the Prophet sallallahu Alayhi wasallam advised us to perform Salah with shoes was to differentiate with the Jews and Christians as at that time they did not pray with shoes.
However today their habits have changed as they pray with their shoes on as is the norm nowadays so to differentiate with them will be to perform Salah without shoes. This is mentioned in Badhlul Majhud:

بذل المجهود في حل سنن أبي داود (3/ 598) [1]

عَنْ يَعْلَى بْنِ شَدَّادِ بْنِ أَوْسٍ, عَنْ أَبِيهِ قَالَ: قَالَ رَسُولُ اللَّهِ -صلى الله عليه وسلم-: «خَالِفُوا الْيَهُودَ, فَإِنَّهُمْ لاَ يُصَلُّونَ فِى نِعَالِهِمْ وَلاَ خِفَافِهِمْ»

قلت: دل هذا الحديث على أن الصلاة في النعال كانت مأمورة لمخالفة اليهود، وأما في زماننا فينبغي أن تكون الصلاة مأمورًا بها حافيًا لمخالفة النصارى،
فإنهم يصلون منتعلين لا يخلعونها عن أرجلهم

If one wishes to pray with shoes, then they may do so in places where there are no carpets like outdoors in parks etc and they must be certain that the shoes are free from filth and Allah knows best.

و قد تطابقت كلمات أهل العلم على أن الصلاة في نعال الشوارع اليوم خلاف الأدب و إن كانت طاهرة، بل سوء الأدب كما تجد تفصيل ذلك في (منية المفتي) للسجستاني و (فتح المتعال) للعلامة المقري و (شرح المشكاة) لعلي القاري و (غاية المقال) للمحدث عبدالحي اللكنوي،
